2An act relating to mobile home parks; amending s.
3723.0612, F.S.; revising provisions for payment by the
4park owner to the Florida Mobile Home Relocation
5Corporation when the mobile home owner chooses to abandon
6the mobile home rather than relocate due to a change in
7use of the mobile home park; providing an effective date.
9Be It Enacted by the Legislature of the State of Florida:
11     Section 1.  Subsection (7) of section 723.0612, Florida
12Statutes, is amended to read:
13     723.0612  Change in use; relocation expenses; payments by
14park owner.--
15     (7)  In lieu of collecting payment from the Florida Mobile
16Home Relocation Corporation as set forth in subsection (1), a
17mobile home owner may abandon the mobile home in the mobile home
18park and collect $1,375 for a single section and $2,750 for a
19multisection from the corporation as long as the mobile home
20owner delivers to the park owner the current title to the mobile
21home duly endorsed by the owner of record and valid releases of
22all liens shown on the title. If a mobile home owner chooses
23this option, the park owner shall make payment to the
24corporation in an amount equal to the amount the mobile home
25owner is entitled to under this subsection one-fourth of the
26maximum allowable moving expenses. The mobile home owner's
27application for funds under this subsection shall require the
28submission of a document signed by the park owner stating that
29the home has been abandoned under this subsection and that the
30park owner agrees to make payment to the corporation in the
31amount provided to the home owner under this subsection section.
32However, in the event that the required documents are not
33submitted with the application, the corporation may consider the
34facts and circumstances surrounding the abandonment of the home
35to determine whether the mobile home owner is entitled to
36payment pursuant to this subsection section.
37     Section 2.  This act shall take effect upon becoming a law.
