  1                      A bill to be entitled

  2         An act relating to water resources; amending s.

  3         373.0831, F.S.; revising requirements related

  4         to water resource development and water supply

  5         development; providing an effective date.

  6  

  7  Be It Enacted by the Legislature of the State of Florida:

  8  

  9         Section 1.  Section 373.0831, Florida Statutes, is

10  amended to read:

11         373.0831  Water resource development; water supply

12  development.--

13         (1)  The Legislature finds that:

14         (a)  The primary responsibilty proper role of the water

15  management districts in water supply is primarily planning and

16  water resource development, but this does not preclude them

17  from assisting providing assistance with water supply

18  development.

19         (b)  The primary responsibility proper role of local

20  government, regional water supply authorities, and public

21  government-owned and privately owned water utilities in water

22  supply is primarily water supply development, but this does

23  not preclude them from assisting providing assistance with

24  water resource development.

25         (c)  Water resource development and water supply

26  development must receive priority attention to ensure, where

27  needed, to increase the availability of sufficient quantities

28  of water for all existing and future reasonable-beneficial

29  uses and natural systems.

30         (2)  It is the intent of the Legislature that:

 1         (a)  Sufficient quantities of water be available for

 2  all existing and future reasonable-beneficial uses and the

 3  natural systems, and that the adverse effects of competition

 4  for water supplies be avoided.

 5         (b)  Water management districts take the lead in

 6  identifying, developing, and implementing water resource

 7  development projects, and be responsible for securing

 8  necessary funding for regionally significant water resource

 9  development projects.

10         (c)  Local governments, regional water supply

11  authorities, and public government-owned and privately owned

12  water utilities take the lead in securing funds for developing

13  and implementing water supply development projects. Generally,

14  the direct beneficiaries of water supply development projects

15  should pay the costs of the projects from which they benefit,

16  and water supply development projects should continue to be

17  paid for through local funding sources.

18         (d)  Water supply development be conducted in

19  coordination with water management district regional water

20  supply planning and water resource development.

21         (3)  The water management districts must shall fund and

22  implement water resource development as defined in s. 373.019.

23  The water management districts are encouraged to implement

24  water resource development as expeditiously as possible in

25  areas subject to regional water supply plans. Each governing

26  board must shall include in its annual budget the amount

27  needed for each the fiscal year to implement water resource

28  development projects, as prioritized in its regional water

29  supply plans.

30         (4)(a)  Water supply development projects which are

31  consistent with the relevant regional water supply plans and

 1  which meet one or more of the following criteria must shall

 2  receive priority consideration for state or water management

 3  district funding assistance:

 4         1.  The project supports establishment of a dependable,

 5  sustainable supply of water which is not otherwise financially

 6  feasible;

 7         2.  The project provides substantial environmental

 8  benefits by preventing or limiting adverse water resource

 9  impacts, but requires funding assistance to be economically

10  competitive with other options; or

11         3.  The project significantly implements reuse,

12  storage, recharge, or conservation of water in a manner that

13  contributes to the protection, restoration, or sustainability

14  of regional water sources.

15         (b)  Water supply development projects which meet the

16  criteria in paragraph (a) and also bring about replacement of

17  existing sources in order to help implement a minimum flow or

18  level shall be given first consideration for state or water

19  management district funding assistance.

20         (c)  If a proposed alternative water supply development

21  project is identified in the relevant approved regional water

22  supply plan, the project shall receive:

23         1.  A 20-year consumptive use permit, if it otherwise

24  meets the permit requirements under ss. 373.223 and 373.236

25  and rules adopted thereunder.

26         2.  Consideration for priority funding pursuant to s.

27  373.1961(2) if the project meets one of the criteria in this

28  subsection.

29         Section 2.  This act shall take effect upon becoming a

30  law.
