2 An act relating to driver license records; amending s.
3 322.142, F.S.; revising the authorized uses of license
4 identification information maintained by the
5 Department of Highway Safety and Motor Vehicles and
6 released to the Department of Children and Family
7 Services; authorizing use for certain adult protective
8 services investigations; providing conditions for such
9 information to be used for verification of identity in
10 determination of eligibility for public assistance and
11 for certain fraud investigations; providing an
12 effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Subsection (4) of section 322.142, Florida
17 Statutes, is amended to read:
18 322.142 Color photographic or digital imaged licenses.—
19 (4) The department may maintain a film negative or print
20 file. The department shall maintain a record of the digital
21 image and signature of the licensees, together with other data
22 required by the department for identification and retrieval.
23 Reproductions from the file or digital record are exempt from
24 the provisions of s. 119.07(1) and shall be made and issued only
25 for departmental administrative purposes; for the issuance of
26 duplicate licenses; in response to law enforcement agency
27 requests; to the Department of State pursuant to an interagency
28 agreement to facilitate determinations of eligibility of voter
29 registration applicants and registered voters in accordance with
30 ss. 98.045 and 98.075; to the Department of Revenue pursuant to
31 an interagency agreement for use in establishing paternity and
32 establishing, modifying, or enforcing support obligations in
33 Title IV-D cases; to the Department of Children and Family
34 Services pursuant to an interagency agreement to conduct
35 protective investigations under part III of chapter 39 and
36 chapter 415; to the Department of Children and Family Services
37 pursuant to an interagency agreement specifying the number of
38 employees in each of that department’s regions to be granted
39 access to the records for use as verification of identity to
40 expedite the determination of eligibility for public assistance
41 and for use in public assistance fraud investigations; or to the
42 Department of Financial Services pursuant to an interagency
43 agreement to facilitate the location of owners of unclaimed
44 property, the validation of unclaimed property claims, and the
45 identification of fraudulent or false claims.
46 Section 2. This act shall take effect July 1, 2010.
