  1                      A bill to be entitled

  2         An act relating to the Elevator Safety

  3         Technical Advisory Committee; creating s.

  4         399.1061, F.S.; reestablishing the committee

  5         within the Division of Hotels and Restaurants

  6         of the Department of Business and Professional

  7         Regulation, notwithstanding abolishment of the

  8         committee pursuant to law; providing for the

  9         membership of the committee; requiring the

10         committee to provide technical assistance to

11         the division; providing for terms of office and

12         for payment of per diem and travel expenses;

13         providing for members of the committee whose

14         terms expired on December 31, 2003, but who

15         have not completed a 4-year term, to continue

16         to hold office until completion of a 4-year

17         term; repealing s. 399.106, F.S., relating to

18         the former Elevator Safety Technical Advisory

19         Committee; providing an effective date.

21  Be It Enacted by the Legislature of the State of Florida:

22  

23         Section 1.  Section 399.1061, Florida Statutes, is

24  created to read:

25         399.1061  Elevator Safety Technical Advisory

26  Committee.--

27         (1)  The Elevator Safety Technical Advisory Committee

28  is created within the Division of Hotels and Restaurants of

29  the Department of Business and Professional Regulation and

30  shall consist of eight members, to be appointed by the

31  Secretary of Business and Professional Regulation as follows:

 1  one representative from a major elevator manufacturing company

 2  or its authorized representative; one representative from an

 3  elevator servicing company; one representative from a building

 4  design profession; one representative of the general public;

 5  one representative of a local government in this state; one

 6  representative of a building owner or manager; one

 7  representative of labor involved in the installation,

 8  maintenance, and repair of elevators; and one representative

 9  who is a certified elevator inspector from a private

10  inspection service. The committee shall provide technical

11  assistance to the division in support of protecting the

12  health, safety, and welfare of the public and shall give the

13  division the benefit of the committee members' knowledge and

14  experience concerning the industries and individual businesses

15  affected by the laws and rules administered by the division.

16         (2)  The committee members shall serve staggered terms

17  of 4 years to be set by rule without salary, but are entitled

18  to reimbursement for per diem and travel expenses as provided

19  in s. 112.061. The committee shall appoint one of the members

20  to serve as chair.

21         (3)  The committee may consult with engineering

22  authorities and organizations concerned with standard safety

23  codes for recommendations to the department regarding rules

24  governing the operation, maintenance, servicing, construction,

25  alteration, installation, or inspection of vertical

26  conveyances subject to this chapter.

27         Section 2.  Any member of the Elevator Safety Technical

28  Advisory Committee whose term of office was terminated on

29  December 31, 2003, as provided by section 399.106, Florida

30  Statutes, but who had held the appointment for less than 4

31  years on that date shall be reappointed for the remainder of

 1  his or her 4-year term. The Secretary of Business and

 2  Professional Regulation shall appoint the other members of the

 3  committee to staggered terms of office as provided by section

 4  399.1061, Florida Statutes.

 5         Section 3.  Section 399.106, Florida Statutes, is

 6  repealed.

 7         Section 4.  This act shall take effect upon becoming a

 8  law.

11                          SENATE SUMMARY

12    Reestablishes the Elevator Safety Technical Advisory
      Committee within the Division of Hotels and Restaurants
13    of the Department of Business and Professional
      Regulation, which expired on December 31, 2003, by
14    operation of law. Provides for members of the committee
      whose terms expired on December 31, 2003, but who had not
15    completed a 4-year term, to continue to hold office until
      completion of a 4-year term.
