  2         An act relating to extracurricular student

  3         activities; amending s. 1002.33, F.S.;

  4         providing that a charter school student is

  5         eligible to participate in extracurricular

  6         activities at a public school, rather than

  7         interscholastic activities only; amending s.

  8         1002.41, F.S.; providing that a home education

  9         student may participate in extracurricular

10         activities, rather than interscholastic

11         activities only; amending s. 1006.15, F.S.;

12         requiring that a student who fails to maintain

13         a certain grade point average while

14         participating in certain extracurricular

15         activities be placed on academic probation

16         before losing eligibility to continue

17         participation in extracurricular activities;

18         providing that the requirement to maintain a

19         certain grade point average does not prohibit a

20         student from participating in an

21         extracurricular activity to the extent that the

22         participation directly relates to the student

23         receiving the credit or one-half credit in

24         physical education which is satisfied by

25         participating in an extracurricular activity;

26         applying the eligibility requirements to all

27         extracurricular activities, rather than to

28         interscholastic activities only; providing an

29         exception; providing an effective date.

31  Be It Enacted by the Legislature of the State of Florida:

 1         Section 1.  Subsection (11) of section 1002.33, Florida

 2  Statutes, is amended to read:

 3         1002.33  Charter schools.--

 4         (11)  PARTICIPATION IN INTERSCHOLASTIC EXTRACURRICULAR

 5  ACTIVITIES.--A charter school student is eligible to

 6  participate in an interscholastic extracurricular activity at

 7  the public school to which the student would be otherwise

 8  assigned to attend under pursuant to s. 1006.15(3)(d).

 9         Section 2.  Subsection (4) of section 1002.41, Florida

10  Statutes, is amended to read:

11         1002.41  Home education programs.--

12         (4)  Home education students may participate in

13  interscholastic extracurricular student activities in

14  accordance with the provisions of s. 1006.15.

15         Section 3.  Section 1006.15, Florida Statutes, is

16  amended to read:

17         1006.15  Student standards for participation in

18  interscholastic extracurricular student activities;

19  regulation.--

20         (1)  This section may be cited as the "Craig Dickinson

21  Act."

22         (2)  Interscholastic Extracurricular student activities

23  are an important complement to the academic curriculum.

24  Participation in a comprehensive extracurricular and academic

25  program contributes to student development of the social and

26  intellectual skills necessary to become a well-rounded adult.

27  As used in this section, the term "extracurricular" means any

28  school-authorized or education-related activity, including,

29  but not limited to, interscholastic activities, occurring

30  during or outside the regular instructional school day.

 1         (3)(a)  To be eligible to participate in

 2  interscholastic extracurricular student activities, a student

 3  must:

 4         1.  Maintain a grade point average of 2.0 or above on a

 5  4.0 scale, or its equivalent, in the previous semester or a

 6  cumulative grade point average of 2.0 or above on a 4.0 scale,

 7  or its equivalent, in the courses required by s. 1003.43(1). A

 8  student participating in an extracurricular activity that is

 9  not interscholastic who fails to maintain a 2.0 average for a

10  semester shall be placed on academic probation for the next

11  semester, but may continue participation in the

12  extracurricular activity.  If, in the next semester, that

13  student fails to increase his or her average to 2.0, he or she

14  must cease any participation in extracurricular activities

15  until a 2.0 average in a semester is achieved.

16  

17  This section does not prohibit a student from participating in

18  an extracurricular activity to the extent that the

19  participation directly relates to the student receiving the

20  credit or one-half credit in physical education satisfied by

21  participation in the extracurricular activity under s.

22  1003.43(1)(j).

23         2.  Execute and fulfill the requirements of an academic

24  performance contract between the student, the district school

25  board, the appropriate governing association, and the

26  student's parents, if the student's cumulative grade point

27  average falls below 2.0, or its equivalent, on a 4.0 scale in

28  the courses required by s. 1003.43(1) or, for students who

29  entered the 9th grade prior to the 1997-1998 school year, if

30  the student's cumulative grade point average falls below 2.0

31  on a 4.0 scale, or its equivalent, in the courses required by

 1  s. 1003.43(1) that are taken after July 1, 1997. At a minimum,

 2  the contract must require that the student attend summer

 3  school, or its graded equivalent, between grades 9 and 10 or

 4  grades 10 and 11, as necessary.

 5         3.  Have a cumulative grade point average of 2.0 or

 6  above on a 4.0 scale, or its equivalent, in the courses

 7  required by s. 1003.43(1) during his or her junior or senior

 8  year.

 9         4.  Maintain satisfactory conduct and, if a student is

10  convicted of, or is found to have committed, a felony or a

11  delinquent act which would have been a felony if committed by

12  an adult, regardless of whether adjudication is withheld, the

13  student's participation in interscholastic extracurricular

14  activities is contingent upon established and published

15  district school board policy.

16         (b)  Any student who is exempt from attending a full

17  school day based on rules adopted by the district school board

18  for double session schools or programs, experimental schools,

19  or schools operating under emergency conditions must maintain

20  the grade point average required by this section and pass each

21  class for which he or she is enrolled.

22         (c)  An individual home education student is eligible

23  to participate at the public school to which the student would

24  be assigned according to district school board attendance area

25  policies or which the student could choose to attend pursuant

26  to district or interdistrict controlled open enrollment

27  provisions, or may develop an agreement to participate at a

28  private school, in the interscholastic extracurricular

29  activities of that school, provided the following conditions

30  are met:

 1         1.  The home education student must meet the

 2  requirements of the home education program pursuant to s.

 3  1002.41.

 4         2.  During the period of participation at a school, the

 5  home education student must demonstrate educational progress

 6  as required in paragraph (b) in all subjects taken in the home

 7  education program by a method of evaluation agreed upon by the

 8  parent and the school principal which may include: review of

 9  the student's work by a certified teacher chosen by the

10  parent; grades earned through correspondence; grades earned in

11  courses taken at a community college, university, or trade

12  school; standardized test scores above the 35th percentile; or

13  any other method designated in s. 1002.41.

14         3.  The home education student must meet the same

15  residency requirements as other students in the school at

16  which he or she participates.

17         4.  The home education student must meet the same

18  standards of acceptance, behavior, and performance as required

19  of other students in extracurricular activities.

20         5.  The student must register with the school his or

21  her intent to participate in interscholastic extracurricular

22  activities as a representative of the school before the

23  beginning date of the season for the activity in which he or

24  she wishes to participate. A home education student must be

25  able to participate in curricular activities if that is a

26  requirement for an extracurricular activity.

27         6.  A student who transfers from a home education

28  program to a public school before or during the first grading

29  period of the school year is academically eligible to

30  participate in interscholastic extracurricular activities

31  during the first grading period provided the student has a

 1  successful evaluation from the previous school year, pursuant

 2  to subparagraph 2.

 3         7.  Any public school or private school student who has

 4  been unable to maintain academic eligibility for participation

 5  in interscholastic extracurricular activities is ineligible to

 6  participate in such activities as a home education student

 7  until the student has successfully completed one grading

 8  period in home education pursuant to subparagraph 2. to become

 9  eligible to participate as a home education student.

10         (d)  An individual charter school student pursuant to

11  s. 1002.33 is eligible to participate at the public school to

12  which the student would be assigned according to district

13  school board attendance area policies or which the student

14  could choose to attend, pursuant to district or interdistrict

15  controlled open-enrollment provisions, in any interscholastic

16  extracurricular activity of that school, unless such activity

17  is provided by the student's charter school, if the following

18  conditions are met:

19         1.  The charter school student must meet the

20  requirements of the charter school education program as

21  determined by the charter school governing board.

22         2.  During the period of participation at a school, the

23  charter school student must demonstrate educational progress

24  as required in paragraph (b).

25         3.  The charter school student must meet the same

26  residency requirements as other students in the school at

27  which he or she participates.

28         4.  The charter school student must meet the same

29  standards of acceptance, behavior, and performance that are

30  required of other students in extracurricular activities.

 1         5.  The charter school student must register with the

 2  school his or her intent to participate in interscholastic

 3  extracurricular activities as a representative of the school

 4  before the beginning date of the season for the activity in

 5  which he or she wishes to participate. A charter school

 6  student must be able to participate in curricular activities

 7  if that is a requirement for an extracurricular activity.

 8         6.  A student who transfers from a charter school

 9  program to a traditional public school before or during the

10  first grading period of the school year is academically

11  eligible to participate in interscholastic extracurricular

12  activities during the first grading period if the student has

13  a successful evaluation from the previous school year,

14  pursuant to subparagraph 2.

15         7.  Any public school or private school student who has

16  been unable to maintain academic eligibility for participation

17  in interscholastic extracurricular activities is ineligible to

18  participate in such activities as a charter school student

19  until the student has successfully completed one grading

20  period in a charter school pursuant to subparagraph 2. to

21  become eligible to participate as a charter school student.

22         (4)  The student standards for participation in

23  interscholastic extracurricular activities must be applied

24  beginning with the student's first semester of the 9th grade.

25  Each student must meet such other requirements for

26  participation as may be established by the district school

27  board; however, a district school board may not establish

28  requirements for participation in interscholastic

29  extracurricular activities which make participation in such

30  activities less accessible to home education students than to

31  other students. Except as set forth in paragraph (3)(c),

 1  evaluation processes or requirements that are placed on home

 2  education student participants may not go beyond those that

 3  apply under s. 1002.41 to home education students generally.

 4         (5)  Any organization or entity that regulates or

 5  governs interscholastic extracurricular activities of public

 6  schools:

 7         (a)  Shall permit home education associations to join

 8  as member schools.

 9         (b)  Shall not discriminate against any eligible

10  student based on an educational choice of public, private, or

11  home education.

12         (6)  Public schools are prohibited from membership in

13  any organization or entity which regulates or governs

14  interscholastic extracurricular activities and discriminates

15  against eligible students in public, private, or home

16  education.

17         (7)  Any insurance provided by district school boards

18  for participants in extracurricular activities shall cover the

19  participating home education student. If there is an

20  additional premium for such coverage, the participating home

21  education student shall pay the premium.

22         Section 4.  This act shall take effect July 1, 2004.

 1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 2                         Senate Bill 1514

 3                                 

 4  Removes the requirement that students must receive a passing
    grade in each core course to participate in extracurricular
 5  activities.

 6  Provides that the section does not prohibit a student from
    participating in extracurricular activities to the extent
 7  required to earn physical education credit.

 8  Provides a probationary period for students who participate in
    non-interscholastic extracurricular activities and fail to
 9  maintain the required grade point average for one semester.

10  Makes conforming changes related to the bill's requirements to
    s. 1002.33, F.S. and s. 1002.41, F.S.
