4     Remove everything after the enacting clause and insert:
5     Section 1.  Subsection (7) of section 110.12315, Florida
6Statutes, is reenacted to read:
7     110.12315  Prescription drug program.--The state employees'
8prescription drug program is established. This program shall be
9administered by the Department of Management Services, according
10to the terms and conditions of the plan as established by the
11relevant provisions of the annual General Appropriations Act and
12implementing legislation, subject to the following conditions:
13     (7)  Under the state employees' prescription drug program
14copayments must be made as follows:
15     (a)  Effective January 1, 2001, through December 31, 2003:
16     1.  For generic drug with card....$7.
17     2.  For preferred brand name drug with card....$20.
18     3.  For nonpreferred brand name drug with card....$35.
19     4.  For generic mail order drug....$10.50.
20     5.  For preferred brand name mail order drug....$30.
21     6.  For nonpreferred brand name drug....$52.50.
22     (b)  Effective January 1, 2004:
23     1.  For generic drug with card....$10.
24     2.  For preferred brand name drug with card....$25.
25     3.  For nonpreferred brand name drug with card....$40.
26     4.  For generic mail order drug....$20.
27     5.  For preferred brand name mail order drug....$50.
28     6.  For nonpreferred brand name drug....$80.
29     (c)  The Department of Management Services shall create a
30preferred brand name drug list to be used in the administration
31of the state employees' prescription drug program.

33This subsection expires July 1, 2004.
34     Section 2.  Section 110.1239, Florida Statutes, is
35reenacted to read:
36     110.1239  State group health insurance program funding.--
37For the 2003-2004 fiscal year only, it is the intent of the
38Legislature that the state group health insurance program be
39managed, administered, operated, and funded in such a manner as
40to maximize the protection of state employee health insurance
41benefits. Inherent in this intent is the recognition that the
42health insurance liabilities attributable to the benefits
43offered state employees should be fairly, orderly, and equitably
44funded. Accordingly:
45     (1)  The division shall determine the level of premiums
46necessary to fully fund the state group health insurance program
47for the next fiscal year. Such determination shall be made after
48each Self-Insurance Estimating Conference as provided in s.
49216.136(11), but not later than December 1 and April 1 of each
50fiscal year.
51     (2)  The Governor, in the Governor's recommended budget,
52shall provide premium rates necessary for full funding of the
53state group health insurance program, and the Legislature shall
54provide in the General Appropriations Act for a premium level
55necessary for full funding of the state group health insurance
56program.
57     (3)  For purposes of funding, any additional appropriation
58amounts allocated to the state group health insurance program by
59the Legislature shall be considered as a state contribution and
60thus an increase in the state premiums.
61     (4)  This section expires July 1, 2004.
62     Section 3.  Subsection (3) of section 624.437, Florida
63Statutes, is reenacted to read:
64     624.437  "Multiple-employer welfare arrangement" defined;
65certificate of authority required; penalty.--
66     (3)  This section does not apply to a multiple-employer
67welfare arrangement which offers or provides benefits which are
68fully insured by an authorized insurer or to an arrangement
69which is exempt from state insurance regulation in accordance
70with Pub. L. No. 93-406, the Employee Retirement Income Security
71Act.
72     Section 4.  This act shall take effect upon becoming a law.
