4     Amendment to Amendment (708283) (with title amendments)
5Between lines 767 and 768 insert:

7     Section 24.  Subsections (8), (9), and (10) of section
8775.21, Florida Statutes, are renumbered as subsections (9),
9(10), and (11), respectively, and a subsection (8) is added to
10said section, to read:
11     775.21  The Florida Sexual Predators Act.--
12     (8)  Chemical castration.-A person designated a sexual
13predator under this section shall be treated with
14medroxyprogesterone acetate (MPA) as provided in s. 794.0235.
15     Section 25.  Paragraph (b) of subsection (1) of section
16794.0235, Florida Statutes, is amended to read:
17     794.0235  Administration of medroxyprogesterone acetate
18(MPA) to persons convicted of sexual battery.--
19     (1)  Notwithstanding any other law, the court:
20     (b)  Shall sentence a defendant to be treated with
21medroxyprogesterone acetate (MPA), according to a schedule of
22administration monitored by the Department of Corrections, if
23the defendant is convicted of sexual battery as described in s.
24794.011 and the defendant has:
25     1.  A prior conviction of sexual battery under s. 794.011;
26or
27     2.  Been designated a sexual predator under s. 775.21.

29If the court sentences a defendant to be treated with
30medroxyprogesterone acetate (MPA), the penalty may not be
31imposed in lieu of, or reduce, any other penalty prescribed
32under s. 794.011. However, in lieu of treatment with
33medroxyprogesterone acetate (MPA), the court may order the
34defendant to undergo physical castration upon written motion by
35the defendant providing the defendant's intelligent, knowing,
36and voluntary consent to physical castration as an alternative
37penalty.
