3     Amendment (with title amendment)
4     Between lines 2146 and 2147, insert:
5     Section 38.  Subsections (1) and (4) of section 116.21,
6Florida Statutes, are amended to read:
7     116.21  Unclaimed moneys; limitation.--
8     (1)  The sheriffs and clerks of the courts of the various
9counties of the state are authorized at their discretion on or
10before September 25 of each and every year hereafter to pay into
11the fine and forfeiture fund of their respective counties, or
12the fine and forfeiture fund created under s. 142.01, any or all
13unclaimed moneys deposited or collected by them in their
14official capacity, which unclaimed moneys came into their hands
15prior to January 1 of the preceding year and for which moneys
16claim has not been made. Any unclaimed moneys collected or
17deposited by the clerk of the circuit court in the course of the
18clerk's court related activities may be processed under this
19chapter; however, the clerk must pay for the cost of publication
20of the list of unclaimed court-related funds. Any unclaimed
21court-related funds collected or deposited by the clerk which
22remain unclaimed must be deposited into the fine and forfeiture
23fund established under s. 142.01.
24     (4)  Except for the cost of publishing the notice for
25the clerk's unclaimed court-related moneys, the cost of
26publishing the notices as required by subsection (2) shall be
27paid by the county commissioners, and the sheriff or the clerk
28shall receive as compensation the regular fee allowed by statute
29for the collection of fines, fees, and costs adjudged to the
30state upon the amounts remitted to the fine and forfeiture fund.
31Upon such payment to the fine and forfeiture fund, the sheriff
32or clerk shall be released and discharged from any and all
33further responsibility or liability in connection therewith.

36     Remove line 220 and insert:
37funds to the Department of Revenue; amending s. 116.21,
38F.S.; authorizing sheriffs and clerks of the courts to pay
39certain deposited or collected funds into a specific fine
40and forfeiture fund; requiring the clerk to pay for the
41cost of publication of the list of unclaimed court-related
42funds; requiring unclaimed funds to be deposited into the
43fine and forfeiture fund; amending s. 119.07,
