4     Remove line(s) 1546-1580 and insert:
5     29.015  Contingency fund; limitation of authority to
6transfer funds in contracted due process services appropriation
7categories.--
8     (2)  In the event that a state attorney or public defender
9incurs a deficit in a contracted due process services
10appropriation category, the following steps shall be taken in
11order:
12     (a)  The state attorney or public defender shall first
13attempt to identify surplus funds from other appropriation
14categories within his or her office and submit a budget
15amendment pursuant to chapter 216 to transfer funds from within
16the office.
17     (b)  In the event that the state attorney or public
18defender is unable to identify surplus funds from within his or
19her office, he or she shall certify this to the Justice
20Administrative Commission along with a complete explanation of
21the circumstances which led to the deficit and steps the office
22has taken to reduce or alleviate the deficit. The Justice
23Administrative Commission shall inquire as to whether any other
24office has surplus funds in its contracted due process services
25appropriation categories which can be transferred to the office
26that is experiencing the deficit. If other offices indicate that
27surplus funds are available within the same appropriation
28category, the Justice Administrative Commission shall transfer
29the amount needed to fund the deficit and notify the Governor
30and the chair and vice chair of the Legislative Budget
31Commission 14 days prior to a transfer pursuant to the notice,
32review, and objection provisions of s. 216.177. If funds
33appropriated for this purpose are available in a different
34budget entity, the Justice Administrative Commission shall
35request a budget amendment pursuant to chapter 216 request a
36budget amendment to transfer funds from the office or offices to
37alleviate the deficit upon agreement of the contributing office
38or offices.
