Section 626.863, Florida Statutes 2003
626.863 Licensed independent adjusters required; insurers' responsibility.--
(1) An insurer shall not knowingly refer any claim or loss for adjustment in this state to any person purporting to be or acting as an independent adjuster unless the person is currently licensed and appointed as an independent adjuster under this code.
(2) Before referring any claim or loss, the insurer shall ascertain from the office whether the proposed independent adjuster is currently licensed and appointed as such. Having once ascertained that a particular person is so licensed and appointed, the insurer may assume that he or she will continue to be so licensed and appointed until the insurer has knowledge, or receives information from the office, to the contrary.
(3) This section does not apply to catastrophe or emergency adjusters as provided for in this part.
