House Joint Resolution
3A joint resolution proposing an amendment to Section 3 of
4Article XI of the State Constitution to limit the subject
5matter of revisions and amendments to the State
6Constitution proposed by initiative.

8Be It Resolved by the Legislature of the State of Florida:
9
10     That the amendment to Section 3 of Article XI of the State
11Constitution set forth below is agreed to and shall be submitted
12to the electors of Florida for approval or rejection at the
13general election to be held in November 2004:

AMENDMENTS
16     SECTION 3.  Initiative.--
17     (a)  The power to propose the revision or amendment of any
18portion or portions of this constitution by initiative is
19reserved to the people, provided that, any such revision or
20amendment, except for those limiting the power of government to
21raise revenue, shall embrace but one subject and matter directly
22connected therewith. It may be invoked by filing with the
23custodian of state records a petition containing a copy of the
24proposed revision or amendment, signed by a number of electors
25in each of one half of the congressional districts of the state,
26and of the state as a whole, equal to eight percent of the votes
27cast in each of such districts respectively and in the state as
28a whole in the last preceding election in which presidential
29electors were chosen.
30     (b)  The subject matter of a revision or amendment to this
31constitution proposed by initiative may not have as its purpose
32any purpose that may be accomplished by general law. For
33purposes of this subsection, a purpose that may not be
34accomplished by general law includes, but is not limited to, a
35purpose to increase or decrease constitutional limits on
36governmental power. For purposes of this subsection, a purpose
37that may be accomplished by general law includes, but is not
38limited to, a purpose to direct the exercise of existing
39governmental power.
40     BE IT FURTHER RESOLVED that the title and substance of the
41amendment proposed herein shall appear on the ballot as follows:

LIMITING SUBJECT MATTER OF INITIATIVE PROPOSALS
43     Proposes an amendment to Section 3 of Article XI of the
44State Constitution to limit the subject matter of constitutional
45revisions and amendments proposed by initiative; provides that
46the subject matter of such a revision or amendment may not have
47as its purpose any purpose that may be accomplished by general
48law; provides that a purpose that may not be accomplished by
49general law includes, but is not limited to, a purpose to
50increase or decrease constitutional limits on governmental
51power; provides that a purpose that may be accomplished by
52general law includes, but is not limited to, a purpose to direct
53the exercise of existing governmental power.
